DATA CONTROLLER AND GENERAL INFORMATION

AZ Food SRL, with registered office at Via Santa Lucia 50, Naples, is the data controller of the personal data provided by users.
AZ Food SRL is committed to safeguarding Users’ right to the protection of personal data.

This Privacy Policy is provided to Users pursuant to and for the purposes of national and European legislation on the protection of personal data, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), as well as any other applicable personal data protection legislation in Italy, including provisions issued by the Data Protection Authority.

Please read the following carefully to understand our views and practices regarding Personal Data and how it will be processed.

DATA PROCESSORS

The Data Controller makes use of data processors to achieve the purposes indicated below and has appointed a designated officer for the protection of personal data (Data Protection Officer or DPO) to oversee compliance relating to personal data.

TYPES OF DATA COLLECTED

Among the Personal Data collected by portaNatura there may be: email address, first name, last name, date of birth, gender, delivery address, ZIP code, delivery city, mobile phone number, tax code or VAT number, Cookies, and Site Usage Data.

Personal Data may be provided directly by the User or, in the case of Usage Data, collected automatically while using the Credobio website.
Unless otherwise specified, all Data requested by the Credobio website is mandatory. If the User refuses to provide it, the Credobio website may be unable to provide the Service. In cases where the Credobio website indicates certain Data as optional, Users are free to refrain from providing such Data, without this affecting the availability or operation of the Service.
Users who have doubts about which Data is mandatory are encouraged to contact the Data Controller.
Any use of Cookies—or other tracking tools—by the Credobio website or by the owners of third-party services used by the Credobio website, unless otherwise stated, is intended to provide the Service requested by the User, in addition to the other purposes described in this document and in the Cookie Policy, if available.

The User assumes responsibility for the accuracy of the Personal Data provided to Credobio.

METHODS AND PLACE OF PROCESSING OF COLLECTED DATA

Methods of processing

The Data Controller adopts appropriate security measures aimed at preventing unauthorized access, disclosure, modification, or destruction of Personal Data.
Processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the purposes indicated.
In addition to the Data Controller, in some cases other parties involved in the organization of the Credobio website (administrative, commercial, marketing staff, legal advisors, system administrators) or external parties (such as providers of administrative and accounting services, couriers and logistics operators, hosting providers and system engineering service providers, payment service providers, IT and online marketing companies) may have access to the Data, and may also be appointed, where necessary, as Data Processors by the Data Controller. The updated list of Data Processors may always be requested from the Data Controller. These providers have access only to the personal data necessary to perform their tasks and are guaranteed not to use such Data for other purposes; they are also required to process Personal Data in accordance with this Privacy Policy and applicable data protection regulations.

Legal basis of processing

The Data Controller processes Personal Data relating to the User if one of the following conditions applies:

  • the User has given consent for one or more specific purposes;
  • processing is necessary for the performance of a contract with the User and/or for pre-contractual measures;
  • processing is necessary to comply with a legal obligation to which the Data Controller is subject;
  • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller;
  • processing is necessary for the purposes of the legitimate interests pursued by the Data Controller or by third parties.

It is always possible to ask the Data Controller to clarify the specific legal basis of each processing operation and, in particular, to specify whether the processing is based on the law, required by a contract, or necessary to enter into a contract.

Place

Data is processed at the Data Controller’s operating offices and in any other place where the parties involved in the processing are located.
The User’s Personal Data may be transferred to a country other than the one in which the User is located, including outside the European Union. When such a transfer occurs, we ensure that it takes place in compliance with this Privacy Policy and that adequate protection is guaranteed.
If one of the transfers described above takes place, the User may refer to the relevant sections of this document or request information from the Data Controller using the contact details provided at the beginning.

Retention period

Data is processed and stored for as long as required by the purposes for which it was collected. In general terms, data will be retained until the fifth anniversary of the account closure date or the last order of portanatura products. In general, data will be deleted after 5 years from the last digital interaction with Credobio.

The following categories of data may be retained for longer periods:

  • financial and accounting Data (e.g., invoices, payments, refunds, etc.) are retained for the period required by applicable tax and accounting laws;
  • all user-generated content (e.g., purchased products, site usage methods) is anonymized but remains available for aggregated analysis.

At the end of the retention period, Personal Data will be deleted. Therefore, once this period has expired, the rights of access, erasure, rectification, and data portability can no longer be exercised.

PURPOSES OF THE PROCESSING OF COLLECTED DATA

User Data is collected to enable the Data Controller to provide and optimize its Services and, in particular, to:

  1. identify the User as necessary for access to the site and to dedicated products and services, as well as to ensure proper development of user support activities;
  2. complete orders and manage payments with appropriate control and security measures;
  3. prepare and deliver orders;
  4. manage invoicing and complete related administrative and tax processes;
  5. provide after-sales assistance and manage support and contact requests;
  6. develop marketing activities related to its Services and analyze and understand customers in order to improve the service (including user interface experience) and optimize the product selection offered.
  • Your personal data may be disclosed to:
    agricultural producers for the direct sale of their products and to comply with legal, accounting, and tax obligations;
  • transport companies or individuals to organize the Delivery Service to the address you indicate;
  • individuals, companies, or professional firms providing assistance and consultancy to Credobio in accounting, administrative, legal, tax, and financial matters related to the provision of the Services;
  • subjects, entities, or authorities to whom disclosure of personal data is mandatory by law or by order of authorities;
  • subjects delegated and/or appointed by Credobio to carry out activities strictly related to the provision of the Service and technical maintenance (including maintenance of network equipment and electronic communication networks such as third-party technical service providers, postal couriers, hosting providers, IT companies, communication agencies).

USER RIGHTS

Users may exercise certain rights with reference to the Data processed by the Data Controller. In particular, the User has the right to:

  • withdraw consent at any time. The User may withdraw previously given consent to the processing of their Personal Data.
  • object to the processing of their Data. The User may object to the processing of their Data when it is carried out on a legal basis other than consent. Further details on the right to object are provided in the relevant section.
  • access their Data. The User has the right to obtain information about the Data processed by the Data Controller, certain aspects of the processing, and to receive a copy of the processed Data.
  • verify and request rectification. The User may verify the accuracy of their Data and request that it be updated or corrected.
  • obtain restriction of processing. When certain conditions apply, the User may request restriction of the processing of their Data. In this case, the Data Controller will not process the Data for any purpose other than storage.
  • obtain erasure or removal of their Personal Data. When certain conditions apply, the User may request erasure of their Data by the Data Controller.
  • receive their Data or have it transferred to another controller. The User has the right to receive their Data in a structured, commonly used, and machine-readable format and to transmit it to another controller without hindrance. This provision applies when the Data is processed by automated means and the processing is based on the User’s consent, a contract to which the User is a party, or related contractual measures.
  • lodge a complaint. The User may lodge a complaint with the competent data protection supervisory authority or take legal action.

Details on the right to object

When Personal Data is processed in the public interest, in the exercise of official authority vested in the Data Controller, or for the purposes of the legitimate interests pursued by the Data Controller, Users have the right to object to such processing for reasons related to their particular situation.

How to exercise your rights

To exercise their rights, Users may send a request to the Data Controller. Requests are handled by the Data Controller as soon as possible and in any case within one month.
